Question

Briefly discuss the Anti-Defection law which is mentioned in the 10th Schedule of the Indian Constitution.

Model answer

The 10th Schedule, popularly known as the Anti-Defection Law, was added to the Indian Constitution through the 52nd Amendment to the Constitution (1985) by the union Government to prevent large-scale defection that began in the 1970s. The purpose of this law is to prevent the elected public representatives from defecting political parties for personal gain.

The Tenth Schedule contains the following provisions regarding disqualification of MPs and MLAs on the ground of defection: -

  1. Grounds for disqualification (Article 102 and 191 gives authority to the 10th schedule of the Indian Constitution to disqualify any member)

  • If an elected member voluntarily gives up the membership of a political party.

  • If he votes in the House or abstains from voting contrary to any direction issued by (whip) his political party.

  • If a member joins a party after being elected independently.

  • If a nominated member joins any political party after the expiry of 6 months.

  • Decisions on questions of disqualification on the ground of defection are vested in the Speaker or the Chairman of the House, and their decision is final.

  • All proceedings in respect of disqualification under this Schedule are deemed to be proceedings in Parliament or the State Legislature.

  1. Exemptions under Anti-Defection Law

  • In a situation where two-thirds of the MLAs of a political party decide to merge with another party, neither the members who decided to join nor the members who remained with the original party will face disqualification.

  • Any person elected as chairman or speaker can resign from his party and if he leaves the post he can rejoin the party.

  • Earlier, the law allowed parties to split, but at present, it has been declared illegal.

  1. Decision making authority

  • Any question relating to disqualification arising out of defection is decided by the Presiding Officer of the House. i.e., speaker in Lok Sabha and chairman in Rajya Sabha.

  • In the context of this Act, efforts have been made by the Supreme and High Courts to make it more effective and fair through its verdict in the Kihoto Holohan case (1992), the Supreme Court clarified that the decision of the Presiding Officer regarding defection would not be final but would be subjected to judicial review.

  • No time frame has been set by the court to take a decision regarding the anti-defection law. However, the court has expressed concern over the unnecessary delay in the decision by the presiding officer.

  • If a member voluntarily leaves his membership, he can be disqualified on grounds of conduct.

The Anti-Defection Law (1985) has definitely taken many efforts in curbing the nature of defection, political stability, respect of mandate and maintaining the importance of party system in Indian democracy, but especially small and regional parties and somewhere in the case of states, it has not been fully effective, which has resulted in political instability and unnecessary change of power again and again.
