Question

Elucidate about the impeachment procedure of the President of India.

Model answer

The President of India can be removed from the office before the expiry of the term through a process called impeachment. This is a quasi-judicial process laid down in Article 61 of the Indian Constitution. The only ground for impeachment is the “Violation of the Constitution”. However, this term has not been define in the Constitution explicitly.

The steps in the impeachment of the President of the India can be seen through the following points:-

  1. Initiation of the Proposal:

  • The process can begin in either House of Parliament (Lok Sabha or Rajya Sabha).

  • The proposal must be signed by at least one-fourth (1/4th) of the total members of the House.

  • A 14-day notice must be given to the President before introducing the resolution.

  1. Admission of the Resolution:

  • After the notice period, the resolution is formally introduced in the originating House.

  1. First House Voting:

  • The resolution must be passed by a two-thirds (2/3rd) majority of the total membership of that House.

  1. Investigation:

  • If the first House passes the resolution, it goes to the second House.

  • The second House investigates the charges (either itself or through a committee).

  1. Second House Voting:

  • After the investigation, if the second House also passes the resolution by a 2/3rd majority of its total membership, the President is considered impeached.

The impeachment of the President of India is a serious and elaborate constitutional process, designed to ensure checks and balances while protecting the dignity of the highest constitutional office, By requiring an overwhelming the consensus across both House, the Constitution ensures that impeachment is used only in the gravest circumstances.
