Question

Discuss the salient features of the Indian Constitution.

Model answer

The Constitution of India, adopted in 1949 and coming into force on January 26, 1950, is a unique constitutional document. It synthesizes foundational principles of democracy, liberty, and justice while adapting global constitutional best practices to suit the diverse socio-political landscape of India.

Salient Features of the Indian Constitution

  • Lengthiest Written Constitution: The Indian Constitution is the world's largest written constitution. It took 2 years, 11 months, and 18 days to draft. Currently, it comprises approximately 470 articles, 25 parts, and 12 schedules.

  • Blend of Rigidity and Flexibility: Under Article 368, some provisions require a special majority or state ratification, while others can be amended by simple legislative majority.

  • Federal System with Unitary Bias: Establishes a quasi-federal structure with a division of powers, yet maintains a strong central authority during emergencies and via single citizenship.

  • Parliamentary Form of Government: Modeled on the Westminster system, emphasizing coordination between the executive and legislative organs at both Union and State levels.

  • Fundamental Rights & Duties: Part III guarantees enforceable fundamental rights to protect individual liberty, balanced by Fundamental Duties added under Part IV-A.

  • Directive Principles of State Policy (DPSP): Part IV outlines socio-economic guidelines aimed at establishing a welfare state.

  • Independent and Integrated Judiciary: Features a unified judicial hierarchy headed by the Supreme Court, ensuring rule of law and constitutional review.

  • Secular State: Guarantees equal freedom and respect to all religions, maintaining principled distance without favoring any state religion.

  • Universal Adult Suffrage: Grants voting rights to every citizen above 18 years without discrimination, anchoring political equality.

Based on the aforementioned facts, it can be stated that the Indian Constitution is not merely a legal manual for governance but a living and progressive social document. It beautifully harmonizes its lofty theoretical ideals with the ground-level and practical realities of India. In short, to quote Dr. B.R. Ambedkar, "However good a Constitution may be, if those who are implementing it are not good, it will ultimately prove to be bad." Over the past seven decades and more, the Indian Constitution has guided the nation on a path of stability, democracy, and continuous progress, thereby demonstrating its enduring relevance.
